Crisis matrimoniales en el Derecho Internacional Privado español

Abstract

Cuando hablamos de crisis matrimoniales no llegamos a saber la importancia que éstas tienen en materia internacional. Cada vez es más frecuente el matrimonio entre personas de diferentes países como resultado del carácter permanente de inmigración, y por consecuente cada vez son más frecuentes los casos de crisis matrimoniales internacionales. Por lo tanto se presentan una gran cantidad de situaciones en las que se necesita normativa en la materia para la solución de conflictos. En Derecho Internacional Privado estas situaciones tienen una regulación complicada ya que existen diferencias muy pronunciadas entre los distintos derechos estatales a la hora de regular esta materia. El sistema jurídico creado en Derecho Internacional Privado para las crisis matrimoniales, se va a crear en diferentes Reglamentos y Convenios, dependiendo de los Estados que forman parte de los mismos. En materia de crisis matrimoniales existen diferentes tipos de disolución del matrimonio, y dependiendo de estos tipos de disolución los textos normativos aplicables son diferentes. Así, existen textos normativos diferentes para divorcio y separación judicial, para nulidad, o incluso supuestos extremos que necesitan de una aplicación aún más complicada. El objetivo de este trabajo es presentar y reflexionar sobre la práctica internacional de las crisis matrimoniales, así como de la competencia, ley aplicable y reconocimiento en la materia, con el fin de facilitar la comprensión de las crisis matrimoniales.

When we speak about matrimonial crises we do not manage to know the importance that these have in international matter. Every time the marriage is more frequent between persons of different countries as result of the permanent character of immigration, and for consistent every time there are more frequent the cases of matrimonial international crises. Therefore they present a great quantity of situations in which regulation is needed in the matter for the solution of conflicts. In Private International Law these situations have a complicated regulation since there exist differences very declared between the different state rights at the moment of regular this matter. The juridical system created in International Law Deprived for the matrimonial crises, it is going to be created in different Bylaws and Agreements, depending on the States that form a part of the same ones. As for matrimonial crises there exist different types of dissolution of the marriage, and depending on these types of dissolution them texts normative applicable they are different. This way, there exist normative different texts for divorce and judicial separation, for nullity, or even supposed ends that they need from an application furthermore complicated. The aim of this work is to present and to think about the international practice of the matrimonial crises, as well as of the competition, applicable law and recognition in the matter, in order to facilitate the comprehension of the matrimonial crises.
