Alquiler turístico y alquiler de temporada. Diferencias e implicaciones derivadas en España

Abstract

En este trabajo se intentan identificar y aclarar las principales diferencias entre alquilar una vivienda con fines turísticos y alquilarla para otros fines de carácter temporal y residencial, dado que nos encontramos en ambos casos con dos tipos de contratos de alquiler que tienen una regulación diferente: el primero de ellos a través de la ordenación turística de las Comunidades Autónomas y el segundo a través de la normativa estatal básica. Se comienza este artículo analizando el alquiler de temporada para después continuar con el alquiler turístico, resaltando sus principales características, y de manera práctica y sencilla las principales diferencias entre ambos. Para delimitar el concepto de arrendamiento de una vivienda con finalidad turística, comúnmente conocido como alquiler vacacional, nos detenemos en la conceptualización de qué se entiende por vivienda con fines turísticos, según, en concreto, en la normativa de ordenación turística de Andalucía.

This paper attempts to identify and clarify the main differences between renting a home for tourism purposes and renting it for other purposes of a temporary and residential nature, given that in both cases we find two types of rental contracts that have different regulations: the first of them through the tourist organization of the Autonomous Communities and the second through the basic state regulations. This article begins by analyzing the seasonal rental and then continuing with the tourist rental, highlighting its main characteristics, and in a practical and simple way the main differences between the two. In order to define the concept of renting a home for tourism purposes, commonly known as vacation rentals, we stop at the conceptualization of what is meant by housing for tourism purposes, according, specifically, in the Andalusian tourism regulations.
