El valor de la costumbre jurídica como fuente del derecho en el pensamiento de Eduardo de Hinojosa

Abstract

Este artículo de investigación trata de exponer la importancia que tuvo el elemento germánico. De forma específica nos referiremos a los monumentos e instituciones germánicas, que invadieron la Península Ibérica sobre el siglo V, y que de manera ejemplar, el ilustre investigador Eduardo de Hinojosa y Naveros en su fundamental obra El elemento germánico en el derecho español, expone y analiza tres tipos de costumbres bárbaras en las que se refieren a la singular manera de impartir justicia por los ciudadanos en la mayoría de las poblaciones de nuestro país, de forma anecdótica, diremos que se hacía con el consentimiento del poder Estado. Esto sucede desde el comienzo de la Baja Edad Media hasta comienzos del siglo XV.

This research article tries to expose the importance of the Germanic element. In a specific way we frequent the Germanic monuments and institutions, which invaded the Iberian Península approximately in the fifth century, and that exemplar, the illustrious researcher Eduardo de Hinojosa y Naveros, in his fundamental work The Germanic element in Spanish law, exposes and analyzes three types of barbarian customs in which they refer to the singular way of impart justice by the citizens in most of the towns of our Country, in an anecdotic way we will say that it was done with the consent of the power of the State. This happens at the beginning of low Middle Age until the beginning of the 15th century.
