El «Juzgado de Términos, Veredas y Cañadas» de la ciudad y obispado de Córdoba (1477-1478)

Abstract

Los Reyes Católicos crearon en Córdoba el "juzgado de los términos e cañadas e veredas" en plena Guerra de Sucesión al Trono de Castilla. Se trata de un juzgado especializado, dedicado en exclusividad a conocer y determinar litigios territoriales, tal vez debido al aumento de la conflictividad, consecuencia de los numerosos debates y disputas existentes sobre la tierra, protagonizados en su mayoría por la codiciosa nobleza y oligarquía de la ciudad y de su reino. Esta decisión de los monarcas formaba parte del conjunto de medidas administrati¬vas que pusieron en marcha para fortalecer la estructura del nuevo estado y reforzar la configuración de una monarquía judicial. Sin olvidar tampoco que esta iniciativa se encuadraba al mismo tiempo dentro del programa pacificador emprendido para poner fin a la guerra civil en Córdoba, sobre todo, en un ámbito como la ciudad y su obispado, donde la perturbación entre facciones adquirió cotas de alta violencia. Este juzgado gozó de singularidad dentro de la administración de justicia de Castilla, ya que los reyes, además de dotarlo de jurisdicción y potestad, insertaron al juez titular de este oficio dentro de la organización municipal de la ciudad y villas del obispado cordobés, con voz y voto en los cabildos.

The Catholic Kings of Spain set up in Córdoba the so called “juzgado de los términos e cañadas e veredas” during the War of Spanish Succession to the throne of Castilla. It was a specialised court of justice, dedicated exclusively to get to know and provide justice on territorial disputes, perhaps because of the increase in this type of conflicts, as a direct consequence of the numerous debates and disputes over the ownership of land led mainly by greedy nobles or by the oligarchy of the city and its kingdom. This decisión of the Spanish kings was conceived within a whole set of administrative measures which were set up to strengthen the structure of the new State and reinforce the configuration of a judicial monarchy. It must also be pointed out that this initiative was included at the same time, in a pacifying programme which was conceived to put an end to the civil war in Córdoba, specially, in the sphere of the city and its bishopric, where the fighting among the different hostility groups became highly violent. This court of justice was somehow peculiar within the administration of justice in Castilla, since the kings, besides providing it with the adequate jurisdiction and authority, commissioned the head judge of this court as a full member of the municipal organisation of the city and the Córdoba bishopric.
