La victimidad como categoría procesal

Abstract

Este trabajo se adscribe a la denominada nueva ola de estudios victimológicos centrada en el “etiquetamiento victimal” así como en la institucionalización de los derechos de las víctimas. Las preguntas a las que se trata de responder son ¿cómo se prueba la victimización para ser reconocida como víctima?; ¿quién “acredita” esta victimidad?; ¿es la victimidad una categoría procesal?; ¿cómo incide el efecto de “cosa juzgada” material y formal en la esfera de la victimidad? y ¿desde y hasta qué momento temporal podemos afirmar que una persona es víctima de un delito?. Adoptamos una postura garantista tanto respecto de los derechos las posibles víctimas (presunción de victimidad) como de los derechos de la persona presuntamente responsable de los mismo (presunción de inocencia) auténtica base del denominado proceso debido.

This paper is appointed to the so-called new wave of victimological studies focused on "victim labelling" as well as on the institutionalization of victims' rights. The questions to be answered are: how is victimization tested to be recognized as a victim? Who can confirm the victimhood? Is the victimhood a procedural category? How does the material and formal effect of "res judicata" affect the sphere of victimization? and from and to what temporary moment can we affirm that a person is the victim of a crime? We adopt a guarantee position regarding both the rights of the possible victims (presumption of victimhood) and the rights of the person allegedly responsible (presumption of innocence), the true basis of the so-called due process.
