El pacto educativo en España: entre el consenso y el disenso

Abstract

El pacto educativo en España es una aspiración en el discurso social y político del último medio siglo. Sin embargo, tras el denominado pacto educativo constituyente, contenido en la Constitución Española de 1978, ha habido más disensos que consensos. Esta tesis tiene como objetivo explorar el espacio posible para un pacto educativo en España, partiendo del tratamiento que se ha dado en el constitucionalismo español al fenómeno educativo, acercándonos al contexto que hizo posible el pacto constituyente de 1978 y analizando el desarrollo legislativo posterior en materia educativa. Finalmente, hemos analizado el último intento de alcanzar un Pacto Social y Político por la Educación, que tuvo lugar en una Subcomisión creada al efecto en la Comisión de Educación y Deporte del Congreso de los Diputados, desde la metodología de la Escuela de Negociación de la Universidad de Harvard para detectar intereses, opciones, alternativas y criterios de legitimidad que nos permitan alcanzar el pacto educativo posible en nuestros días.

The educational pact in Spain has been an aspiration in social and political discourse for the last half-century. However, following the so-called constituent educational pact contained in the Spanish Constitution of 1978, there has been more dissent than consensus. This thesis aims to explore the possible space for an educational pact in Spain, starting with the treatment given to the educational phenomenon in Spanish constitutionalism, approaching the context that made the constituent pact of 1978 possible, and analyzing subsequent legislative developments in educational matters. Finally, we have analyzed the latest attempt to reach a Social and Political Pact for Education, which took place in a Subcommittee created for this purpose in the Education and Sports Commission of the Congress of Deputies, using the methodology of the Harvard Negotiation Project to detect interests, options, alternatives, and legitimacy criteria that allow us to achieve the possible educational pact in our days.
