Publicidad encubierta a través de influencers: Normativa aplicable y régimen de responsabilidad

Abstract

Este trabajo aborda la problemática relativa a la publicidad encubierta llevada a cabo por los denominados influencers. El interés del asunto está fuera de duda. De hecho, se trata de una práctica cada vez más relevante (en términos cualitativos y cuantitativos) en un mercado en creciente proceso de digitalización. El estudio se inicia con una caracterización general de la publicidad encubierta. A continuación, se analizan las distintas normas que regulan esta modalidad de publicidad. Al mismo tiempo, se presta atención al régimen de responsabilidad en que incurren todos los sujetos implicados, según se infiere de cada una de las normas estudiadas. El trabajo concluye con unas reflexiones finales sobre la materia analizada.

This paper deals with the problems of surreptitious advertising carried out by the so-called influencers. The interest of the subject is beyond doubt. In fact, it is an increasingly relevant practice (in qualitative and quantitative terms) in a market in a growing process of digitalisation. The study begins with a general characterisation of surreptitious advertising. It then goes on to analyse the different rules that regulate this type of advertising. At the same time, attention is paid to the liability regime incurred by all the parties involved, as inferred from each of the regulations studied. The paper concludes with some final reflections on the matter analysed.
