El controvertido asunto de la función normativa del falseamiento de la competencia por actos desleales (Art. 3 LDC)

Abstract

Este trabajo trata de encontrar respuesta a la cuestión fundamental de cuál es la función normativa del art. 3 LDC: ¿se trata de una norma de atribución de competencias o, por el contrario, tipifica un verdadero ilícito concurrencial? Con tal propósito, el autor parte de exponer las distintas tesis que la doctrina ha defendido al respecto, desgranando su significado y los argumentos en los que se basan. Seguidamente, analiza y valora críticamente la función normativa del art. 3 LDC que parece inferirse de nuestro Derecho vigente; especialmente, tras las últimas reformas antitrust, entre las que destaca la producida por la incorporación al ordenamiento español de la Directiva 2014/104/UE sobre acciones de daños por infracciones del Derecho de la competencia.

This paper tries to find an answer to the fundamental question of what is the normative function of the art. 3 LDC: is it a rule for the attribution of competences or, on the contrary, does it typify a true concurrent illicit? With this purpose, the author starts by exposing the different theses that the doctrine has defended in this regard, shelling their meaning and the arguments on which they are based. Next, it analyzes and critically assesses the normative function of art. 3 LDC that seems to be inferred from our current Law; especially after the last antitrust reforms, among which the one produced by the incorporation into Spanish legislation of Directive 2014/104/EU on actions for damages for infringements of competition law.
