Las ordenanzas de convivencia y su relación con la Ley de seguridad ciudadana: ¿Quién desplaza a quién?

Abstract

En los últimos quince años un buen número de municipios ha aprobado sus ordenanzas de convivencia ciudadana en las que ha tipificado muchísimas infracciones y sanciones en la materia. La doctrina y la jurisprudencia las han acogido sorprendentemente bien y, en general, no las han criticado como se merecían. Todo lo contrario ha ocurrido con la LOPSC, que ha previsto en muchos casos las mismas infracciones que las ordenanzas, y que, sin embargo, sí ha recibido críticas innumerables y especialmente duras por hacer lo mismo que antes hicieron ellas. Con todo, una de las mayores debilidades. de la LOPSC es que haya ignorado casi por completo a esas ordenanzas. Ni ha articulado su relación con ellas ni ha enmarcado su régimen sancionador. De hecho, con lo poco que dice sobre ellas –y lo mal que lo hace– puede hasta propiciar que tipifiquen más infracciones que antes. Un verdadero despropósito.
