Clasificación y traducción al español de los binomios contractuales estadounidenses

Abstract

Este artículo pretende arrojar luz sobre los binomios contractualesen inglés y ofrecer un glosario inglés-español de estas estructuras que facilite su compresión y trasvase. Para ello, se compiló un corpus virtual con 25 plantillas de contratos de arrendamiento de larga duración de Luisiana, a partir de las cuales, con CQL deSketch Engine, se recuperaron y clasificaron 186 binomios según la categoría gramatical, la relación semántica, la variabilidad o invariabilidad y los nexos. Respecto al glosario, tiene 38 entradas, con los binomios más asiduos extraídos con N-gramas de Sketch Engine, que incluyen versiones españolas basadas en textos paralelos, recursos lexicográficos y literatura científica legal y de traducción jurídica. Estas recogen también las técnicas de traducción empleadas y notas con variantes y observaciones metalingüísticas y traductológicas. Los resultados muestran el predominio de los binomios nominales, sinónimos o cuasisinónimos, irreversibles y con el nexo or, y de la aplicación de la elisión y la traducción literal para trasvasar binomios sinónimos o cuasisinónimos y de extrema especificidad, y complementarios y antónimos respectivamente. Así pues, se deduce que la relación semántica influye en el procedimiento traslativo

This article aims to shed light on contractual binomials in English and to provide an English-Spanish glossary of these structures that facilitates their understanding and translation. To this end, a virtual corpus with 25 Louisiana long-term lease agreement templates was compiled, from which 186 binomials were retrieved and classified by grammatical category, semantic relation, variability or invariability, and nexus, using Sketch Engine CQL. The glossary has 38 entries, with the most frequent binomials extracted by Sketch Engine N-grams, which include Spanish versions based on parallel texts, lexicographic resources and legal scientific and legal translation literature. The entries also include the translation techniques used, and notes giving variants and metalinguistic and translation comments. The results show a predominance of: binomials that are nominal, synonymous or quasi synonymous, irreversible and with the nexus “or”; the application of elision and literal translation to transfer synonymous or quasi synonymous and extremely specific binomials, and complementary and antonymous binomials, respectively. From this, it may be deduced that semantic relationship influences the translation technique.
