La seguridad en el constitucionalismo actual: condición de posibilidad de la dignidad humana

Abstract

El fin del Constitucionalismo es el establecimiento de un sistema político-jurídico que haga posible que el ser humano lleve una vida digna. Para alcanzar este objetivo es necesario que el Estado proporcione seguridad. Las teorías filosóficas contractualistas y utilitaristas han aportado importantes reflexiones que propiciaron la inclusión de referencias a la seguridad desde los primeros textos constitucionales. El alcance de la seguridad va de la mano del modelo constitucional En la actualidad resulta inconcebible una noción de seguridad que no incluya también en su alcance los fines propios del Estado social. Por ello, el concepto clásico de seguridad se ha visto ampliado por los conceptos de seguridad humana y de seguridad nacional, que abordan diferentes dimensiones de la protección y el bienestar, ya sea a nivel estatal o individual. Así pues, el contenido de la noción de seguridad desde el punto de vista constitucional debería ampliarse e incluir tanto los roles tradicionales de prestación de seguridad por parte del Estado como aquellos otros derivados de la consecución y mantenimiento de las condiciones económicas, sociales y políticas necesarias para el desarrollo y progreso de la nación.

The aim of Constitutionalism is the establishment of a political-legal system that makes it possible for human beings to lead a dignified life. To achieve this goal, it is necessary for the State to provide security. Contractualist and utilitarian philosophical theories have contributed important reflections that led to the inclusion of references to security from the earliest constitutional texts. The scope of security goes hand in hand with the constitutional model. Nowadays, a notion of security that does not also include the aims of the social State is inconceivable. Therefore, the classical concept of security has been expanded by the concepts of human security and national security, which address different dimensions of protection and well-being, either at the State or individual level. Thus, the content of the notion of security from a constitutional point of view should be broadened to include both the traditional roles of security provision by the State and those derived from the achievement and maintenance of the economic, social, and political conditions necessary for the development and progress of the nation.
