El método de delimitación marítima en tres etapas: concreción y desarrollo a través de la jurisprudencia internacional reciente

Abstract

Este trabajo estudia la concreción y el desarrollo del método de delimitación marítima en tres etapas sobre la base de las sentencias y laudos internacionales recientemente dictados por la Corte Internacional de Justicia, el Tribunal Internacional del Derecho del Mar y los tribunales arbitrales. De acuerdo con este método, la primera etapa consiste en el trazado de una línea provisional media o equidistante; en la segunda etapa se ajusta dicha línea provisional en caso de que concurran circunstancias relevantes; y, finalmente, en la tercera etapa se verifica la proporcionalidad del resultado alcanzado. Se coligen las virtudes de este método conducente a una solución equitativa y se subraya el diálogo muy positivamente mantenido entre las cortes y tribunales internacionales.

This paper analyses the creation and develop-ment of the three-stage maritime delimitation method through the international judgements and arbitral awards recently delivered by the International Court of Justice, the International Tribunal for the Law of the Sea and the arbitral tribunals. According to this method, the first stage is the drawing of a provisional equidistant or median line; along the second stage, that provisional line may be ad-justed whether there are relevant circumstances; finally, in the third stage the proportionality of the result is verified by means of the disproportionality test. The article concludes the advantages of this method as far as it is useful to achieve an equitable solution, highlighting the positive dialogue held between the international courts and tribunals.
