El derecho urbanístico y la ciudad sostenible. Un análisis propedéutico del caso de la República del Ecuador

Abstract

El objeto del presente artículo es analizar, partiendo de conceptos de carácter general, la relación actual entre derecho urbanístico y ciudad sostenible, y con especial relación al caso ecuatoriano. En este sentido, la realidad actual ecuatoriana es paradigmática en cuanto a la existencia de un número limitado de normativa jurídica adecuada, la práctica inexistencia de estudio del derecho urbanístico en la Academia, y de una falta de políticas de implementación de la normativa y, en su caso, de su sanción por incumplimiento. Desde otra óptica, esta situación ofrece la posibilidad de realizar auténticas políticas que propicien un desarrollo urbanístico sostenible.

The purpose of this article is to analyze, based on concepts of a general nature, the current relationship between urban law and sustainable city, and with special reference to the Ecuadorian case. In this sense, the current Ecuadorian reality is paradigmatic in terms of the existence of a limited number of adequate legal regulations, the lack of practice of urban planning law in the Academy, and a lack of policies to implement the regulations and, in your case, your sanction for noncompliance. From another point of view, this situation offers the possibility of proposing authentic policies that propitiate a sustainable urban development. Finally, the present work aims to verify the hypothesis that the legal regulations of Urban Law is not truly autonomous, sufficient, coherent and duly applied, unable to guarantee the development of sustainable cities, for which we will take as reference the framework of time space of reality Ecuadorian.
