Crímenes de Lesa Majestad Divina y delitos contra la religión del estado o contra la libertad de cultos

Abstract

Los crímenes de lesa majestad divina y otros en cuya represión interviene un fuerte componente confesional penetran en el ordenamiento decimonónico hispano bajo el régimen punitivo de la legislación recopilada.

Al compás de los avances en el proceso codificador, el hecho religioso recibirá cambiantes tratamientos: sin contar propuestas de legeferenda, habrá delitos contra la religión del Estado, con diferentes gama y matiz, en los Códigos de 1822 y 1848, vuelta entremedias la Novísima Recopilación, contra la libertad de cultos en el de 1870, evolución paralela al devenir del constitucionalismo español e itinerario que procura cartografiar el presente trabajo.
