La legislación complementaria del Código Penal de 1870, durante el “Sexenio Democrático”

Abstract

Se cumplen 150 años de la Constitución española de 1869 y del consiguiente e inmediato Código Penal de 1870 que supusieron un avance legislativo democrático de enormes proporciones para la España del Sexenio Democrático (1868-1874). Este Código Penal que nació con cierta vocación de provisionalidad fue sin embargo el de mas larga vigencia y experimentó diversas y sucesivas reformas y la promulgación de diferentes leyes específicas y decretos que lo desarrollaron y completaron durante su larga vigencia hasta 1925. En esta aportación se estudian las normas legales que al respecto se promulgaron durante el Sexenio Democrático, hasta 1874.

150 years of the Constitution of 1869 and the subséquent Pénal Code of 1870 are fulfilled, winch supposed a democratic législative advance of enormous proportions for the Spain of the democratic sexennium (1868-1874). This pénal code, which was bornwith a certain vocation of provisionality, was nevert heless the one with the longest validity, as it was an Advanced text for its time. Nevertheless, this penal textun derwent diverse and successive reforms and the promulgation of differents pecific laws and decrees that developed and complete ditduringits long termuntil 1925. In the present study the periodun der analysis is delimited to that corresponding to the stage of the democratic sexenium, and 1874.
