Del ordenamiento al sistema en el derecho islámico clásico. Un análisis en clave comunicacional

Abstract

El artículo explora la distinción entre ordenamiento y sistema jurídico en la Sharía a partir de la Teoría comunicacional del Derecho. El ordenamiento jurídico es una totalidad textual que en sí misma es inoperativa, pues necesita del sistema jurídico paraque sus normas queden debidamente delimitadas e interpretadas. A través del surgimiento y desarrollo de la Sharía y del fiqh analizamos el desarrollo histórico a través del cual se forman los diferentes sistemas jurídicos del Islam sunní y que nos llevaráa confirmar la distinción entre ordenamiento y sistema propugnada por la TCD y a concluir que existen tantos sistemas como escuelas y, por ende, tantas Sharías como escuelas.

The article explores the distinction between legal order and legal system in Sharia based on the Communicational Theory of Law. The legal order is a textual entirety that, in itself, is inoperative because it requires the legal system for rules to be properly delimited and interpreted. Through the emergence and development of Sharia and fiqh, we analyze the historical development through which the different legal systems of Sunni Islam are formed. This analysis leads us to confirm the distinction between legal order and system advocated by the Communicative Theory of Law, concluding that there are as many systems as there are schools, and consequently, as many Sharias as there are schools.
