Panorama jurídico-histórico de la familia luso-brasileña

Abstract

El artículo presenta una visión panorámica jurídico-histórica de la Familia en Brasil. Sin descuidar aspectos socio políticos, recorre las grandes líneas del proceso histórico que se bifurcó desde el siglo XVI hasta nuestros días. Las fuentes jurídicas fueron privilegiadas en la observación de la institución multisecular de la Familia. La investigación permite percibir la profunda penetración de valores espirituales en la Familia en el inicio de la Historia brasileña. La consonancia entre los poderes temporal y espiritual es nítida a lo largo del periodo colonial. El proceso de secularización de la sociedad también es revelado a partir del siglo XX.

The article presents a legal-historical overview of the institution of the Family in Brazil. Without neglecting socio-political aspects, it covers the main lines of the historical process that unfolded from de 16th century to the presente day. The legal sources were privileged in the observation of the multi-secular institution of the Family. The investigation allows us to perceive the deep penetration of values in the Family at the beginning of Brazilian History. The consonance between temporal and spiritual powers is clear throughout the colonial period. The historical process of secularization of society is also unveiled from the 20th century onwards.
