La teoría comunicacional del derecho a debate

Abstract

En este trabajo vamos a analizar la Teoría Comunicacional del Derecho del profesor Gregorio Robles, destacando sus principales elementos y profundizando en la misma. El objetivo es poner la Teoría Comunicacional del Derecho en conexión con el ejercicio de la abogacía. Quizás sea en esta profesión donde las máximas de la Teoría Comunicacional del derecho puedan justificar la necesidad de armonizar esa la dualidad entre ordenamiento y sistema. La necesidad de depurar el texto bruto, el cual se encuentra totalmente fragmentado, que requiere la labor de los juristas especializados en una determinada materia para ordenarlo, puede resultar sumamente eficaz para que estos puedan interpretar y aplicar las normas con una mayor coherencia.

In this paper we are going to analyze the Communicative Theory of Law of Professor Gregorio Robles, highlighting its main elements and going deeper into it. The objective is to put the Communicative Theory of Law in connection with the practice of law. Perhaps it is in this profession where the maxims of the communicational theory of law can justify the need to harmonize the duality between order and system. The need to purify the gross text, which is totally fragmented, and which requires the work of jurists specialized in a certain matter to put it in order, can be extremely effective so that they can interpret and apply the rules with greater coherence.
