La familia: ¿institución o contrato? Un análisis de la situación actual

Abstract

El carácter institucional e «histórico tradicional » de la familia dentro de los sistemas de organización social hace arriesgado cualquier intento de ingeniería social que pretenda elaborar una modificación artificial de esta institución. Ciertos síntomas del colapso social actual están íntimamente ligados al debilitamiento al que está siendo sometida esta institución natural. Las reformas legislativas en España en los últimos años, algunas de ellas casi fuera de los límites constitucionales, parecen favorecer un proceso de desestructuración social que beneficia la proliferación de una «ciudadanía de masas» que sería más fácil de liderar con un Estado altamente fortalecido.

The institutional and ≪traditional historical≫ character of the family within the systems of social organization makes risky any attempt at social engineering that attempts to elaborate an artificial modification of this institution. Certain symptoms of the current social breakdown are closely linked to the weakening to which this natural institution is being subjected. The legislative reforms in Spain in recent years, some of them almost outside the constitutional limits, seem to benefit a process of social destructuring that favors the proliferation of a ≪mass citizenship≫ that would be easier to lead by a highly strengthened State.
