La justicia en el ordenamiento deportivo español

Abstract

El objetivo de la investigación es analizar los protocolos sobre los que se sustenta el sistema de control de las decisiones disciplinarias en el Derecho deportivo español (derecho fundamentalmente federativo), advirtiendo sus virtudes y defectos. Cuando un jugador practica una modalidad deportiva, por lo general, gracias a las normas constitutivas del juego sabe aquello que ―puede hacer‖ o que está ―prohibido hacer‖ y sabe, igualmente, si recibirá por ello una sanción. La disciplina deportiva (como parte del Derecho deportivo) nos informa de cuáles deben ser las consecuencias jurídicas de nuestros actos dentro de un marco concreto de competición deportiva. Pero para ello se requiere de un proceso mediante el cual las correspondientes autoridades competentes puedan decidir. En España la Justicia Deportiva ha estado regulada, después de la Ley del Deporte de 1990 y las sucesivas reformas, por un sistema eminentemente público, si bien la doctrina ha venido exigiendo que se marque una neta distinción entre el proceso sancionador (propio del Estado) y el disciplinario deportivo que debería tener una naturaleza privada. Los resultados de la investigación realizada permitirán comprender en donde deberá actuar fundamentalmente el legislador, a los efectos de conseguir una mejor reelaboración legislativa cuando el actual proyecto de Ley termine por convertirse definitivamente en una nueva Ley del Deporte.

The objective of the research is to analyze the protocols on which the control system for disciplinary decisions in Spanish sports law (fundamentally federative law) is based, noting its virtues and defects. When a player practices a sport, generally, thanks to the constitutive rules of the game, he knows what he "can do" or is "prohibited to do" and also knows if he will receive a sanction for doing so. Sports discipline (as part of sports law) informs us of what the legal consequences of our actions should be within a specific framework of sports competition. But this requires a process by which the corresponding competent authorities can decide. In Spain, the Sports Justice has been regulated, after the Sports Law of 1990 and the successive reforms, by an eminently public system, although the doctrine has been demanding that a clear distinction be made between the sanctioning process (typical of the State) and the sports disciplinarian who should have a private nature. The results of the research carried out will make it possible to understand where the legislator should act fundamentally, in order to achieve a better legislative reworking when the current bill ends up becoming definitively a new Sports Law.
