El tipo básico de financiación ilegal de los partidos políticos. Crítica y problemas de interpretación

Abstract

El título XIII bis del CP, “De los delitos de financiación ilegal de los partidos políticos” fue introducido en el año 2015 por la LO 1/2015, de 30 de marzo. Dentro de este título, el art. 304 bis CP, en sus puntos uno y cuatro, recoge el tipo básico de financiación ilegal de los partidos políticos, donde se castiga la entrega o recepción de donaciones o aportaciones ilegales (aquellas que infrinjan el artículo 5.Uno de la LOFPP) destinadas a un partido político. La redacción final del tipo básico de financiación ilegal de los partidos políticos ha sido objeto de crítica, principalmente por haber dejado fuera muchas conductas que, a pesar de tener una gravedad y afectación al bien jurídico protegido similar, no han sido incorporadas por el legislador penal. El objetivo de este artículo es, sobre la base del estudio del bien jurídico protegido, realizar un análisis crítico del objeto material, la conducta típica y las “atipicidades” que presenta este tipo penal.

The title XIII of the CP “De los delitos de financiación ilegal de los partidos políticos” was introduced in 2015 by the LO 1/2015, de 30 de marzo. In this title, the article 304 bis, points one and four, regulates the crime of illegal funding of political parties. It punishes the delivery or the reception of illegal donations (those which infringe article 5.1 LOFPP) destined to a political party. This configuration of the crime has been widely criticized since it has left out of its scope many acts with a similar importance and affectation to the protected legal good. The goal of this article is to analyse, taking into consideration the protected legal good, the object of this crime, the criminal act and the “atypical” acts that this crime presents.
