El tratamiento político-jurídico de la muerte y la desaparición en frontera desde un enfoque de Derechos Humanos

Abstract

La falta de vías de acceso legales y seguras a territorio de España y la UE para las migraciones provoca que se incrementen dramáticamente las cifras de personas desaparecidas y fallecidas sin identificar en las fronteras españolas y europeas. En el presente artículo se analizan las disfunciones estructurales existentes en el marco político‐jurídico de gestión de esta realidad, que conllevan graves vulneraciones de los derechos fundamentales de las víctimas directas y sus familiares. Partiendo de la premisa de que la solución de fondo pasa ineludiblemente por habilitar las citadas vías de acceso legales y seguras, planteamos alternativas políticas y jurídicas plausibles para mejorar la búsqueda de las personas desaparecidas, la identificación y el trato digno de las fallecidas y la garantía de los derechos de sus familiares.

Absence of legal and safe pathways to access a territory of Spain and EU to migratory flows entails a dramatic increase of rates of missing persons and unidentified bodies at Spanish and European borders. In this paper we analyze the structural malfunctions of political‐legal frame of management of this reality, that bring serious fundamental rights violations of the victims and their relatives. Being aware of that the final solution necessarily for generating the legal and safe pathways mentioned, we propose political and legal alternatives feasible in order to improve the searching of missing migrants, the identification and dignified treatment of dead bodies and guarantee of their relatives» rights.
