La protección de los derechos fundamentales desde el Derecho internacional privado: el caso de la maternidad subrogada

dc.description.abstract | La maternidad subrogada es una técnica de reproducción humana asistida especial en tanto supone un acuerdo de voluntades en las que la mujer gestante se presta a desarrollar el embarazo para posteriormente entregar a los padres intencionales el niño al que dé a luz. En el Derecho comparado encontramos distintos posicionamientos desde países donde es válido y está regulado a Estados como España que lo prohíben totalmente dándole nulidad de pleno derecho al contrato (art. 10 Ley 14/2006). Puesto que la filiación es determinada por la legislación que regula la maternidad subrogada, el turismo reproductivo e incluso el fraude a la ley, hace que la doctrina española se divida entre la aceptación y reconocimiento de esa decisión a la consideración de que por su nulidad de pleno derecho no puede surtir ningún efecto en nuestro ordenamiento. Tanto el contrato como la división doctrinal afectan a la protección de derechos fundamentales de todas las partes como puede ser la dignidad, la igualdad y protección de los hijos, la no discriminación por nacimiento, la identidad única o el derecho a la vida privada y la intimidad familiar. El contrato de maternidad subrogada pone muchos valores sobre la mesa como puede ser la dignidad de la madre subrogada y del niño que nacerá y su riesgo de mercantilización y cosificación, hasta dónde llega la autonomía de las partes, la no discriminación a la hora de formar una familia, los derechos del niño, la igualdad de los hijos y el interés superior del menor, y, por último, la seguridad jurídica y el orden público internacional. El Registro Civil español inscribe los hechos relativos a los españoles por lo que se discute si se debe dar reconocimiento a la certificación de nacimiento expedida por un registro extranjero de un español y si la filiación se determina conforme a la legislación española en todo caso o únicamente cuando los tribunales españoles conocen del asunto por primera vez. Por último, al nacer los menores en el extranjero el Registro Civil consular juega un papel clave al recibir la mayoría de solicitudes de inscripción. El cónsul general, como Encargado, deberá, de momento, realizar un reconocimiento incidental de la decisión extranjera de acuerdo con las instrucciones que reciba de la DGRN. | es_ES |
dc.description.abstract | Surrogate motherhood is an especial assisted reproductive technique since it involves an agreement in which a woman compromise to carry on the gestation and later on she will deliver the baby to the intentional parents. In Comparative Law, different stances can be found: from countries where is valid and is regulated to States like Spain that prohibits completely giving the contract automatic nullity (art. 10 Law 14/2006). Given that filiation is determined by the legislation that regulates surrogacy, Cross-‐Border Reproductive Care and even Legal Fraud, makes the doctrine be divided between the acceptance and recognition of that decision and the opinion that the contract will cause no effect in our legal order due to its nullity The contract, as much as the doctrinal division affects the protection of fundamental rights of all parties such as dignity, equality and protection of the children, non-‐discrimination based on birth, unique identity or the right to private life and family privacy. Surrogacy contract puts a lot of values on the table like the surrogate mother and the child dignity, the risk of commercialization and reification, the limit of the free will of the parties, non-‐discrimination in forming a family, child rights, equality of children and best interests of the child, and last, legal security and International Public Order. The Spanish Civil Registry inscribes the facts relatives to Spaniards. For this reason there is a discussion if it should give recognition to a birth certificate issued by a foreign registry and if the filiation should be determined according to Spanish legislation in every case or just when Spanish court are seised of the matter for the first time. In the end, since the children are born abroad, the Civil Registry at the Spanish Consulate plays a key role. It receives most of the birth inscription applications. At the moment the Consul General, as the person in charge, should make an incidental recognition of the foreign decision according to the instructions given by the DGRN. | es_ES |
