La línea jurisprudencial como instrumento esencial para conocer el Derecho

Abstract

En el Derecho Administrativo debe incluirse el estudio de jurisprudencia y como técnica debe enseñarse a identificar correctamente líneas jurisprudenciales. Se trata de adquirir herramientas necesarias en un contexto en el que las fuentes del derecho han mutado dados los cambios notables que se han presentado en el principio de separación de poderes, pues el juez (sobre todo el administrativo) lejos de ser un autómata que aplica matemáticamente normas, en su labor hermenéutica es un verdadero creador de reglas jurídicas.

The analysis of case-law needs to be included into Administrative Law. Accordingly, it is crucial to teach how to identify lines of case-law. They are important tools in the current legal context, in which the sources of law have profoundly changed as a consequence of deep changes in the separation of powers. For that reason, judges (and especially administrative judges) cannot merely apply the law as if it were a mathematical operation. On the contrary, they have the task of creating legal rules.
