El Derecho de Desistimiento del consumidor. En especial, tras su reforma por el Real Decreto-Ley 24/2021

Abstract

Este trabajo tiene el objetivo principal de analizar el régimen del derecho de desistimiento del consumidor tras la reforma llevada a cabo por el Real Decreto-ley 24/2021, de 2 de noviembre. El estudio parte de una breve introducción que aborda la incorporación de este derecho a nuestro ordenamiento jurídico, para centrarnos seguidamente en sus presupuestos de aplicación y excepciones. A continuación, profundizaremos en su régimen jurídico, analizando las modificaciones sufridas tras la incorporación de diferentes Directivas Europeas. Por último, se abordarán las especialidades que presenta el derecho de desistimiento en los contratos de contenidos digitales, cerrando nuestro trabajo con unas sucintas conclusiones.

The main objective of this paper is to analyse the regime of the consumer's right of withdrawal, following the reform carried out by Royal Decree-Law 24/2021, of 2 November. The study begins with a brief introduction that deals with the incorporation of this right into our legal system, and then focuses on the conditions for its application and the exceptions to the right of withdrawal. We will then go into its legal regime in depth, analysing the modifications made after the transposition of the different European Directives. Finally, we will address the special features of the right of withdrawal in digital content contracts, closing our work with some brief conclusions.
