Conservación del patrimonio en la Constitución de 1978

Abstract

Se plantea y se analiza en esta conferencia el contenido y el significado del artículo 46 de la Constitución de 1978, que utiliza una fórmula muy amplia y un tanto imprecisa, o tal vez tautológica, pero que nos permite fundamentar que nuestra Constitución con la expresión patrimonio cultural, omnicomprensiva del patrimonio histórico y artístico, más técnica que jurídicamente está refiriéndose a nuestras señas de identidad como pueblo, a los valores y trascendentales intereses tanto materiales (cosas) como inmateriales (costumbres y tradiciones) que nos caracterizan como tal, que nos legaron las generaciones que nos precedieron y sobre los cuales recae el deber de su conservación por los poderes públicos (Estado, Comunidades Autónomas y Administraciones locales) y, en su defecto por nosotros mismos

This talk poses and analyzes the question of the content and meaning of article 46 of the Constitution of 1978. The article uses a formula which is very broad and somewhat imprecise, or perhaps tautological, but which enables us to establish that our Constitution, with the expression cultural heritage, encompassing all of the historic and artistic heritage, is referring more technically than legally to our distinguishing features as a people, to the values and transcendent interests, both material (things) and intangible (customs and traditions) which characterize us as such, handed down to us by the generations which preceded us and with regard to which there arises the duty of their Conservation by the public authorities (State, Autonomous Communities and Local Government) and, failing these, by ourselves
