Metodología para un Derecho Deportivo de la montaña

Abstract

La montaña ha dejado de ser el espacio místico y solitario que ofrece al hombre una vía de escape a la cotidianeidad del convivir en sociedad. La montaña es ahora un espacio abierto al hombre medio, es cada vez más un lugar de recreo y práctica deportiva que necesita de una ordenación de su explotación y vivencia social. Esta comunicación propone una metodología para la construcción del llamado Derecho de la Montaña, desde una perspectiva heterogénea de las normas jurídicas acorde con la tipología de normas señaladas en la reciente Teoría Comunicacional del Derecho. Ahora bien, no debe descuidarse la dimensión ética, es decir el conjunto de bienes y valores que tan atractivas han hecho a las montañas y su adecuada protección jurídica para garantizar la integridad y el futuro de las mismas.

The mountain isn’t the mystical and lonely space that offers to the men a runaway from the daily nature of the social cohabitation. Now the mountain is an open space to the middle man, progressively it is leisure and sports place that needs one regulation of his use and social living. This work proposes a methodology for the construction of the called Mountain Law from the heterogenic prospective of the rules of Law according to the typology of rules signed in the recent Communicational Theory of Law. Well them, it not be neglected the ethical dimension, that is the set of goods and values of the mountain and his appropriate legal protection to ensure the integrity and the future of her.
