Biopolítica y biolegitimidad: Apuntes desde el tratamiento del asilo y refugio

Abstract

En este artículo, se parte de los conceptos de biopolítica y biolegitimidad, trabajados por Michel Foucault y Didier Fassin respectivamente, aplicados al proceso de asilo y al reconocimiento de la condición de refugiado, con el objetivo de demostrar un hilo conductor entre el ejercicio de gobierno de la vida y el reconocimiento de un valor de la misma. Tomar como base el asilo y refugio, permite atender al proceso mediante el cual se introduce a un sujeto bajo la esfera de control de un Estado, que habrá de proporcionarle una protección en el caso de que quede demostrada su desprotección previa. Analizar esa continuidad entre ambos conceptos que hacen referencia a distintas maneras de entender las políticas de la vida, sirve para entender la manera en la que los Estados entienden su responsabilidad respecto de los sujetos.

In this article, we start from the concepts of biopolitics and biolegitimacy, worked by Michel Foucault and Didier Fassin respectively, applied to the asylum process and the recognition of refugee status, with the aim of demonstrating a guiding thread between the exercise of government of life and the recognition of a value of it. Taking asylum and refuge as a base, it allows to address the process by which a subject is introduced under the sphere of control of a State, which will have to provide him with protection in the event that his previous lack of protection is demonstrated. Analyzing this continuity between the two concepts that refer to different ways of understanding the politics of life, serves to understand the way in which states understand their responsibility towards the subjects.
