Tras varios años recibiendo duras críticas, el Tribunal de Justicia de la Unión Europea ha accedido, finalmente, a modificar su jurisprudencia sobre el requisito del idem en su construcción sobre el non bis in idem. En bpost y Nordzucker y otros, el TJUE ha establecido que el requisito del idem debe entenderse como idem factum en todos los ámbitos del derecho de la UE, incluyendo el derecho de la competencia. La motivación de esta decisión no resulta clara. El presente artículo sugiere que distinguir el concepto material y el concepto procesal del non bis in idem y, sobre todo, asumir que el TJUE se ha adherido a este último, podría ayudar a comprender esta nueva jurisprudencia. After several years under harsh criticism, the Court of Justice of the European Union has finally accepted to review its case law on the idem condition in the ne bis in idem doctrine. In bpost and Nordzucker & others, the ECJ has adjudicated that the idem condition must be understood as idem factum in every field under EU Law, including competition law. The grounds for this decision remain unclear. This paper suggests that a clear distinction between a procedural and a substantive concept of non bis in idem and, specially, the acknowledgment of the ECJ’s endorsement of the latter, may help to understand its most recent case law.
