El presente trabajo tiene por objeto analizar y comparar, desde una perspectiva terminológica y traductológica, la realidad jurídica, tanto en España como en Francia, en materia conyugal, particularmente el régimen patrimonial e intereses pecuniarios de los cónyuges: las capitulaciones matrimoniales. Este tipo de convenciones de carácter patrimonial quedan regidas en ambos ordenamientos jurídicos por lo dispuesto en el Código Civil de cada país en cuestión. Porconsiguiente, resultará pertinente realizar un estudio comparado de los fundamentos legales y las disposiciones normativas que rigen todo lo relativo a las capitulaciones matrimoniales en Francia y España para, posteriormente, determinar los distintos tipos de regímenes económicos matrimoniales en cada ordenamiento, lo que nos permitirá considerar las posibles equivalencias terminológicas en español y francés, atendiendo a los aspectos léxico-semánticos que resulten de interés traductológico. The purpose of this paper is to analyse and compare the legal reality of Spain and France in matrimonial matters from a terminological and perspective. In particular, the study will be addressed through the law of matrimonial property, marital property systems and the prenuptial agreement. In both legal systems, this subject is covered by the Civil Code of each country in question. Therefore, we will carry out a comparative study of the legal foundations and provisions that govern the prenuptial agreements in France and Spain in order to subsequently determine the different marital property systemsin each legislation. This will allow us to reflect onthe possible terminological equivalences in Spanish and French, considering the lexical-semantic aspects that may be of interest in terms of translation.
