La institución judicial contra la creación poética: el proceso a Les fleurs du mal

Abstract

Les fleurs du mal (Las flores del mal), colección de poemas que inician la poesía moderna, fue censurada por Napoleón III, alegando que ultrajaban la moralidad pública y religiosa. Ambos, la acusación de M. Pinard y el alegato de Me Gustave Chaix d’Est-Ange, se formularon en versículos seleccionados para tal fin. Este artículo se centra en el proceso judicial cuyo fallo ordenó el pago de una multa al poeta y la retirada de seis poemas de la colección.

Les fleurs du mal (The Flowers of Evil), the collection of poems which starts modern poetry, is censored by the authoritarian government of Napoleon III of outrages against public and religious morality. Both, the indictment by M. Pinard and the pleading by Me Gustave Chaix d’Est-Ange, were formulated on selected verses for this purpose. This paper focuses on the judicial process whose court judgement ruled the payment of a fine to the poet and the removal of six poems from the collection.
